|The Future of Wellness Plans After the AARP v. EEOC Decision

|In a suit brought by the American Association of Retired Persons (AARP), the U.S. District Court for the District of Columbia ruled against the Equal Employment Opportunity Commission (EEOC), saying that portions of the EEOC’s final wellness regulations related to wellness incentives were arbitrary. The court ordered the EEOC to review the rules and make changes to satisfy the court. Although the current ruling does not change anything immediately, it raises questions about how employers will handle their wellness plans in the future. This webinar will review current EEOC regulations and the existing HIPAA wellness rules, and will help employers think about how to prepare for possible changes to the EEOC rules resulting from the AARP case. Also note that by this time, we will know once and for all whether Congress has made any changes to the ACA rules this session. If any significant changes have been made, we will shorten our wellness discussion and provide an update on new developments.|
